Civic Access
SIMPLE CIVIC ACCESS
Anyone has the right to request documents, information or data subject to mandatory publication under current legislation in cases where public administrations have failed to publish them on their website. Civic access is therefore limited to acts, documents and information subject to publication obligations.
PROCEDURES FOR EXERCISING SIMPLE CIVIC ACCESSThe request for simple civic access is not subject to any restrictions regarding the subjective legitimacy of the applicant, does not need to be justified, is free of charge and must be submitted to the Head of Corruption Prevention and Transparency (RPCT), Dr Antonio Capone.
The request may also be sent electronically, in accordance with the procedures set out in Legislative Decree No. 82 of 7 March 2005, as amended, by sending it to the following email address: segreteria.conisma@pec.it
If the request is accepted, the administration will publish the requested data, information or documents on the website and notify the applicant of the publication, providing a hyperlink to the requested information.
Anyone has the right to access data and documents held by public administrations, in addition to those subject to publication, in compliance with the limits relating to the protection of legally relevant interests as provided for in Article 5 bis of Legislative Decree No. 33/2013. This type of civic access has been provided for with the aim of promoting widespread forms of control over the pursuit of institutional functions and the use of public resources, and of encouraging participation in public debate. Generalised civic access can therefore be exercised in relation to data and documents held by public administrations, in addition to those for which there is already a specific obligation to publish.
PROCEDURES FOR EXERCISING GENERALISED CIVIC ACCESSThe request for general civic access is not subject to any restrictions regarding the subjective legitimacy of the applicant, does not need to be justified, and is free of charge. The application may also be submitted electronically, in accordance with the procedures set out in Legislative Decree No. 82 of 7 March 2005, as amended, by sending it to the following email address: segreteria.conisma@pec.it The parties concerned may submit a reasoned objection to the request for access within ten days of receiving the notification, using the same methods described above. If the request is accepted, the Authority shall attach the requested data and documents to its reply. in the event of total or partial refusal of access or failure to respond within thirty days of the submission of the request, or in cases where the request for access is granted despite their reasoned opposition, the parties concerned may submit a request for review to the Head of Corruption Prevention and Transparency, Dr Antonio Capone, who shall issue a reasoned decision within twenty days.
